Seapull Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tosemum Holdings LLC, an Arizona limited liability company based in Surprise, Arizona ("Seapull," "we," "us"), governing your use of the Seapull mobile app and the seapull.com website (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use Seapull.

The Service is offered in the United States only.

1. Eligibility

You must be at least 18 years old to use Seapull. By creating an account you represent that you are 18 or older, that you can lawfully enter this agreement, that you have never been convicted of a sexual offense or required to register as a sex offender, and that you are not prohibited by law from using a dating service. We enforce the 18+ rule technically (an under-18 date of birth cannot create a profile) and through reports; misrepresenting your age is grounds for immediate termination.

2. Your account

• One account per person, tied to your own accurate information. No accounts on behalf of others.
• You're responsible for keeping your login credentials confidential and for all activity under your account.
• Your profile must be you: your real recent photos, truthful details. Impersonation and fake profiles are prohibited (section 6).

3. The Service

Seapull connects people through shared physical activities. We provide introductions, matching based on activity compatibility, and messaging. Seapull is an introduction service only. We are not a party to any interaction, communication, or meeting between users, and we do not arrange, supervise, or accompany meetups.

The Service is currently in beta; features may change, break, or be removed (beta testers: see the Beta Tester Agreement).

4. No screening

We do not conduct criminal background checks, identity verification, or any other screening of users. A "verified" badge, where offered, indicates only that a user completed our in-app photo-verification step. It is not an identity check, background check, or endorsement. Automated photo screening (Privacy Policy section 5) checks images for explicit or violent content only; it does not confirm who is in them. You are solely responsible for evaluating anyone you interact with.

5. ASSUMPTION OF RISK: IN-PERSON MEETINGS AND PHYSICAL ACTIVITIES

Read this section carefully. It is the heart of these Terms.

Seapull's purpose is to help you meet people in person to do physical activities together: hikes, runs, climbs, workouts, and similar. Both parts carry inherent risk:

• Meeting strangers involves risk. People may misrepresent themselves. We do not vet users (section 4). You alone decide whether, when, where, and with whom to meet, and YOU MEET OTHER USERS AT YOUR OWN RISK.
• Physical activity involves risk. Activities arranged through Seapull, including exertion, terrain, equipment, traffic, and Arizona heat, can cause injury or worse. You are responsible for knowing your own fitness, limits, and medical condition, and for judging the safety of any activity, location, and conditions. YOU PARTICIPATE IN ACTIVITIES AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISKS ARISING FROM YOUR INTERACTIONS AND MEETINGS WITH OTHER USERS AND FROM ANY ACTIVITY UNDERTAKEN WITH THEM, AND YOU AGREE THAT SEAPULL IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ON OR OFF THE SERVICE, OR FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM USER MEETINGS OR ACTIVITIES.

Safety guidance. Not a substitute for your own judgment: meet in public places (Seapull's design favors public venues by intention); tell a friend where you're going and with whom; arrange your own transportation both ways; stay sober enough to stay in control; for outdoor activities, respect heat, hydration, daylight, and trail conditions; and trust your instincts. Leave if something feels off. Use the in-app block and report tools; in an emergency, contact 911 first.

6. Community rules: prohibited conduct

Do not:

• Harass, threaten, stalk, intimidate, or defame anyone, on or off the Service.
• Create fake profiles, impersonate anyone, or misrepresent your age or identity.
• Use Seapull while under 18, or interact with anyone you know to be under 18.
• Post content that is illegal, hateful, sexually explicit, violent, or that you lack rights to.
• Solicit money from users, advertise, spam, or use Seapull for commercial purposes.
• Use another user's information for any purpose outside Seapull, or contact users off-platform against their wishes.
• Scrape, harvest, probe, reverse-engineer, or attempt to bypass technical protections (including rate limits such as daily likes, and location protections).
• Attempt to access accounts, conversations, or data that are not yours.

We may investigate violations, remove content, restrict features, and suspend or terminate accounts (section 10). We may report unlawful conduct to law enforcement.

7. Blocking, reporting, and moderation

Seapull provides in-app blocking and reporting (with reasons including harassment, fake profiles, underage users, inappropriate messages, and spam; reports may attach the specific message or photo). During beta, reports are reviewed by our team within a reasonable time (target: 24 to 48 hours). Blocking stops all contact and visibility: a blocked pair can no longer see each other's profile or send each other messages. Evidence attached to an open report is preserved even if the reported account is deleted (see Privacy Policy section 7).

8. Your content

• You own the content you post (photos, bio, messages).
• You grant Seapull a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process your content for the purpose of operating, securing, and improving the Service, ending when your content is deleted (except as retained for safety or legal purposes per the Privacy Policy). Processing includes automated screening of photos for prohibited content. We do not use your content for advertising and do not sell it.
• You represent that you have all rights to what you post, and that photos depict you.
• We may remove content that violates these Terms.

9. Seapull's property

The Seapull app, name, logo, design, and code are owned by Tosemum Holdings LLC and protected by law. We grant you a personal, non-transferable, revocable license to use the app on your device for its intended purpose. No other rights are granted.

10. Termination

• By you: delete your account in-app at any time (Profile tab, then Account, then Delete account). What happens to your data is described in Privacy Policy section 7 and on our Account Deletion page.
• By us: we may suspend or terminate your account at any time for violation of these Terms, risk to other users, unlawful conduct, or (with reasonable notice where practicable) discontinuation of the Service. Deleting your account does not erase open safety cases.
• Sections 5, 8 (as to retained content), and 11 through 15 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT ANY MATCH, MEETING, OR RELATIONSHIP WILL RESULT; OR THAT ANY USER IS WHO THEY CLAIM TO BE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) TOSEMUM HOLDINGS LLC, ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE OR FROM INTERACTIONS OR MEETINGS WITH OTHER USERS; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNTS YOU PAID SEAPULL IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain exclusions; where prohibited, these limits apply to the fullest extent permitted.

13. Indemnification

You agree to indemnify and hold harmless Tosemum Holdings LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your interactions or meetings with other users, or your violation of these Terms or of law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at legal@seapull.com and attempt informal resolution for 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.

15. General

• Changes: we may update these Terms; material changes will be announced in the app before taking effect. Continued use after the effective date is acceptance.
• Severability: if a provision is unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale.
• Entire agreement: these Terms plus the Privacy Policy (and, for beta testers, the Beta Tester Agreement) are the entire agreement between you and Seapull.
